Orbit chemical wants solicitor-general jailed over 11.4bn court award.

Chemical firm Orbit wants Solicitor-General Njee Muturi jailed for refusing to settle an Sh11.4 billion award following a protracted court battle over a 92.2-acre piece of prime land near Jomo Kenyatta International Airport, Nairobi.Orbit Chemical Industries says Mr Muturi has failed to settle the award issued by the court in 2012 and should be compelled to explain why he should not be cited for insubordination and contempt of court and be personally committed to civil jail.“We also seek orders compelling the solicitor-general to settle the decretal sum of Sh6,015,113,000 with interest at court rates from March 4, 2008 and costs as agreed between the parties in the settlement agreement within 14 days,” argues lawyer Christine Oseko.

Government risks compensating Orbit Chemicals 18bn in land dispute.

The government could be forced to pay Sh18 billion of public funds to a manufacturing company for failing to settle a court order issued four years ago. This follows a decision by Justice Edward Muriithi allowing Orbit Chemical Industries Limited to pursue the amount awarded to it in 2012 after the government took its 95 acre land in Embakasi to settle squatters. The initial amount awarded by Lady Justice Roseline Nambuye in 2012 was Sh6 billion, but the company says the interest has accrued to Sh18 billion which they want the government to pay within 14 days.

Court awards 11 billion to Orbit Chemicals

The government has been ordered to pay a local manufacturing firm, Orbit Chemical Industries, in excess of Sh11.4 billion for loss of use of its 100 acre-prime land in Nairobi’s Embakasi area.The government would have paid Sh6 billion when they first entered an agreement to settle the matter in 2008 which has now attracted interest of more than Sh5 billion. “By reason of what has been stated, an order be and is hereby made and ordered that judgment be and is hereby entered against the defendant in the sum of Sh6 billion,” Justice Roselyn Nambuye said in the ruling issued on Friday. Legal experts said the award is the largest slapped against the Kenyan government. The Judge said that since the interest was not included in the compromise, the court ordered interest to run at court rates from March 2008 when as assessment was done.

Court permits 1.1bn Stanbic pensioners suit.

A Nairobi judge has allowed former Stanbic Bank employees to pursue Sh1.1 billion in terminal dues arising from the lender’s 2007 merger with CFC Bank. Lady Justice Roselyn Nambuye dismissed a preliminary objection to the suit raised by Stanbic saying it would deny the pensioners enjoyment of the fruits of their litigation. Stanbic through Obura and Mbeche Advocates had argued that the Court of Appeal had stayed the dispute in the High Court. The bank also argued that the pensioners’ case had already been determined by a court. The pensioners through lawyer Matthew Oseko asked the court to enter a liquidated judgement against Stanbic for Sh532 million plus interest at a commercial rate of 20 per cent from the date the suit was filed in 2004.

Stanbic and CFC merger shelved.

It was a double win for 15 former employees of Stanbic Bank Kenya Limited Friday. First, the High Court allowed their application to suspend the much hyped merger with CFC Bank. The court also declined to refer their pension dispute to the Retirement Benefits Authority for settlement. The temporary order has dealt a major blow to the merging of SBK and CFC, which was set to be concluded on May 30, 2008.

The merger was the biggest financial transaction in recent times in the country as the asset base runs into over Sh70 billion. Lady Justice Roselyn Nambuye ordered Stanbic to deposit with the court Sh532 million to cater for the terminal dues of its former workers before the merger can proceed.

Courts put Kenya and Uganda railway privatisation on hold.

The conclusion of the privatisation of the Kenya and Uganda railways has suffered a serious setback after courts stopped it over pension benefit disputes. In Kampala, former employees of the Uganda Railways Corporation (URC) went to court on December 7 challenging the concessioning of the organisation before their dues were paid. High Court judge Arach Amoko granted the injunction and gave the corporation 15 days from November 30 to file its defence. A similar injunction was granted last Thursday to 6,000 members of the Kenya Railways Pensioners Association (Kerapa), when High Court judge Jacktone Ojwang stopped the concessioning, pending the hearing and conclusion of the case.
